Hello, I'm new to this site and hoping someone with more experience with GA labor law can inform me if what my employer is doing in illegal. I work as a privatesecurity supervisor for a large company in GA. My position is considered "seasonal/full-time," but I am subject to work any and every holiday (as is expected in ant security/law enforcement job) and do work year around. The way my employer gets away with not giving myself and seven other people in my position is appearently considering us terminated at the end of each year, but then re-hiring us back, thus considering us "seasonal" although we're actually not. I work year around and 40+ hours a week with no vacation time, sick leave, overtime pay, you name it. No benefits whatsoever, while the supervisors above me enjoy Thanksgiving, Christmas, and New Years off, plus multiple days surrounding those holidays and get an excellant benefits package. Is there any possible way I can get this changed and if so, who would I need to talk to?

Thanks,

Marshall

There are only certain types of seasonal industries where overtime is not required. These businesses are generally closed part of the year; that's what makes them seasonal. Based on your post, unless you qualify as an exempt employee, you should be receiving overtime. Even though you personally may work more during specific times of the year, that does not, in and of itself, exempt your employer from overtime because they run a "seasonal" business.

There are no federal or state laws which require an employer to offer "vacation time, sick leave, overtime pay, etc.".

I understand and thanks for responding. It is just perplexing that My self and a several others work more than anyone else in this business and dont enjoy the same benefits as others. I guess that is just the nature of the beast. But thanks for responding.
