i have a coworker who was injured by a dry ice bomb that another employee made and a third employee threw at the 1st employee. what legal rights do this injured employee have ? this is on federal property {airport}.

This employee has the legal right to sue all those involved and his union representation if they did not act accordingly!

Depending on the whole situation, there may be employer liability with the federal government, but cannot figure that out based on what you have written because the Federal Tort Claims Act is rather strict in terms of what has to be proved for the fed govt to be liable. Sounds like there may be personal liability against the other employees and their supervisor, if they were supposed to be monitored and were not, but this would likely be under state law. IF the person is a union member, the collective bargaining agreement may speak to how to deal with this kind of situation also. Usually, reporting, investigation, assessment, etc...should follow and then some kind of disability may be in order and other medical assessments. I suggest speaking with an employment law attorney as this is intricate based on the facts, many not known in this post, which would dictate the best way to proceed.

I am in Texas, and I work for a Temp agency. I fell on the job on the 17th of oct.05 and I was banged up pretty good, but being the trooper that I am although I knew immediately my ankle was sprained and my forearm was skinned I went right on working. I was a little sore and still am, but i wasnt to concerned about ot untill my lower back and right leg began to hurt intensely on the 24th. At the time of the accident there were several witnesses and they asked if I was ok and I responded "I think so", but know one ever came around to file an accident report. When I went to work on the 24th I brought it up to my supervisor, who was absent the day it happened, and he asked how it happened, where it happened and who saw it and went to HR to file the report and he was told then that I had to file thru my temp agency. MY concern is the agency filed the claim and I went to the Dr. they suggested and he took xrays and performed some movement tests etc. and hie response was I see a little artheritis, and called my pain back strain... he did not address my intense leg pain nor did he prescribe meds that help. Can I seek further treatment from another DR.? And is it covered under Workers Comp.?
