View Full Version : Extended breaks, without pay in Pennsylvania

My son, 17, works for a fast food restaraunt. He is given a schedule of days and times to report for work a week in advance. Frequently, when the restaraunt is slow, they will ask him to go on unpaid break, sometimes as long as 2 1/2 hours. Besides being unethical, is this legal?

It is not illegal, or unethical, for an employer to send an employee home when there is no work for them to do, and call them back when there is.

However, if you are saying that your son is required to log out, but remain on the premises until there is work for him to do again, that's a different story. Are you saying that?
