i just recently moved to texas and when i was living in wisconsin i had gone to a orthodontist and got work done on my teeth. my sister who also lives with me when to the same orthodontist and got the same work done. the orthodontist put a metal retainer piece in each of our mouths and all of this work was documented and paid for. when we moved to texas my sister and i went to see a new ortho to get braces. it turned out that the retainer pieces that were put in our mouths (both me and my sisters) were left on for too long (long enough that our ortho in wisconsin should have done something about it- this was not due to our moving and not being able to see an ortho in that duration of time) because of this it took a lot of extra time (months) to get braces and both me and my sister had to have extra stuff done to our teeth because the retainer that the previous ortho put on messed them up. it caused both me and my sister a lot of additional pain (to the extent where we were prescribed pain killers weekly) our ortho in texas made a statement that what the previous ortho did was not done right. i need someone to review this issue and tell me if there are any legal options both me and my sister have to resolve this problem. we both have documentation of all of this as well. Thank you.

"dental negligence" "dental malpractice"?

"Expert witness"?

"Compensatory damages"?
"Damages for pain and suffering"?

Hard to answer because the standards of care in Wi and TX may differ and it may be that the ortho in WI did what he did based on your teeth at that poitn in time, and maybe things changed by the time you go to TX and that ortho acted within the standard of care. So it is hard to really say. You can talk to a malpractice attorney, but I doubt your case would be taken because it does not sound like you would likely recover anything since I imagine both orthos ahve the xrays and so on to back up the treatment plans.
