New Jerseynew jerseynew jersey.

Had my last day with my former employer. They have not sent me my last paycheck. I have tried contacting them about this, to no avail.

Can I sue them myself or do I have to go through NJ Dept of Labor ?

if you have a claim, you can either file a complaint with wage and hour division of dol or bring private suit. However, I think the law on this is not that they give you check on final day, but rather no later than the end of the normal pay period immediately following your separation. That is, if payday is every other friday, and you leave the first wednesday, you may have to wait until that next friday's regular pay period. and they can mail it to you.

Last day of pay period was a Thurs. which was my final day. Payday is the next day (Fri.). I came for the check and they didn't have it. Have been waiting.
Thanks for the help. Any advantages/ disadvantages to filing with Department of Labor ?

The DOL is free. A lawyer is not.

in court you might get a few (minor) remedies the dol doesn't, but for one week's check it likely won't be worth it. Contact the DOL. Jersey's got a decent website and might allow you to file online. I forget the DOL's address, but the state's portal is www.state.nj.us. click thru to dol and then wage and hour.
