i work in nc for a very large retailer I know the law states that there is no lunch break required no matter how many hours worked i usually worked 10 -12 hours per day sometimes not getting a break because of being the only manager on duty was not allowed to leave the store It says in ther handbook that a lunch "should" be scheduled.I was wondering if there is any action that could be taken I complained about this to my supervisor but he did nothing about it?

Since breaks are not required by law, there is no legal action to be taken even if the company doesn't follow their internal policies. You can take whatever internal grievance procedures your company affords, but unless you have an enforceable contract that guarantees lunch breaks, this is not a matter for an attorney or even the DOL.

Besides, there's a difference between saying a lunch "should" be scheduled and that one "will" be scheduled.
