Hi, My name is LH. I live in california. In Dec 20' 2001, I got hit by other driver. I got minor neck pain. I went to see the lawyer and he refered me to a Dr. chiroperactor. I went to Dr.'s office. He told me to fill out paper works and he did not give me any copies. I just filled out and signed the paper works then he took me in his office and closed the door. After he took my exays, he told me "5 minutes before and 5 minutes after no body knows what happened to your pain" and told me "you have to write more and write alot more". I added my back pain i have. .First 2 weeks, he asked me "How much is your damage estimate" I told him $2200. The Dr. told me to get 2nd estimate, then he refered me to the bodyshop he knows. I went there and told them honestly and came back his office with estimate $3500. After 10 appointments seeing the Dr., I did not want to go back again because I feel better I told him. The Dr. told me that I have to see him 60 times then the insurance would pay for my medical bill. I was lying on his bench, and then he adjusted my neck, back, and chest. The next 11th appointment, I came back the Dr. adjusted my neck, back, and chest. The 12th, ...19th appointment, I have more pain. The 20th appointment, I went back and told my Dr. "I was in Walmart my chest was so painful if I moved my body". The pain was the same amount for 3 times before I have next appointment. The Dr. said "I don't know" I was blind to belive in this chiroprator that he would hurt me. I went to other medical doctor at Kaiser. Kaiser Dr. told me that it takes times to get over the pain. I believed her and went to different chiroprator to get more opinions. Almost two years, I still not settle my case. First I really want other driver to pay for the cause, but then I would not pursue the case because the Dr. chiropractor made me more pain than other driver did. My chest still bothers me for 2 years.
My Dr. chiropractor billed me $4500. What should I do now? I really appreciate for any helps. Thank you.

Hi LH. I'm new to this forum, but the case you describe sounds a lot like the sort of thing I used to hear about when working for an insurance defense firm in Los Angeles.
Did your case get settled? If not, I'd be glad to provide whatever information I can. As a paralegal I can only provide information and refer to you web sites with good information, but I would think you would want to get a second opinion from another attorney and another doctor before you went ahead with any medical care recommended by the first chiropractor you consulted.

I was stopped on the freeway in Tempe Arizona, due to a traffic bottleneck. A ramp was closed off converting 4 lanes to 3. With many cars in front of me a noticable ordeal of hundreds of IDOL Automobiles.
I was rear ended, hauling a small trailer full of cement blocks, my trailer was damaged as well as every block was broked in pieces. The hitch itself was bent up 90 degrees as was the tongue.
As I got out of my vehicle the rear ender (defendant) was saying to me,
"cell phones should be outlawed" I replied you were talking on your cell? he said no! I (he) was looking for the time on my (his) cell, which he said it again in front of the DPS Officer. And I made notice to the DPS officer that he wittnessed this fact from him.
The trailer was also attached by a chain (law) after the main hit from the toyota pick up truck the chain caused a chain reaction hitting my van over and over.
I am seeking therapy presently.
I did some reasearch found that whiplash reoccurs 10 and 20 years after the incident. I also notice that my pain is getting worse, I also read that's a possiblity, it's true.
I tried to do some laboring tasks the pain set in later on, so I guess I have to stop everything.
I'm like a veggie, this should be productive time for me now. but it's not.
I counted 10 more repeatitive hits from the tongue damage on the back of my Mini Van Hatch.
My back, lower back, between my shoulder blades and my neck are in pain
My right hand is in pain
My right foot is in pain
Migraine Headaches
Dizziness
Negligence
Whip Lash
Personal Property is settled, the Ins. has taken responsibility.
What else is there I can sue for?
Any and all info would be greatly appreciated, It's been two weeks since the accident 4/9/5 saturday @ 12:30pm
I'm loosing out on lost oppertunities, I purchase and refurbish homes. my home is 1/2 painted, I have 300 cement blocks to lay.
I have been offered free materials, I cannot pick them up because of my new disabilities. Consequently I have to let them go.
My profit margin is of major interest to me, material costs are extremely expensive. this has effected my life style emensly.
My life has stopped, my days are therapy now. Rather than productive.
My home will take much longer to finish and much longer to sell to collect my profit from my hard work. My profits will be extended rather than profiting in months and able to reinvest immediately. therefore reinvesting will be delayed as well.

I am not sure how to answer these. Usually in an accident, there will be a finding of fault that will govern who is liable to pay what for damages. damages are in multiple categories: property, personal injury are the major categories; within property damages- damage to the vehicles, buildings, poles, etc...; with personal injury- bodily damages, medical costs; another category of damages are pain and suffering, lost wages and income, etc....
Some damages are actual damages and others are compensatory in nature and others are based on future calculations
