I was terminated on November 8th, 2005. If my memory serves me correct I am intitaled to my last paycheck in 3 days and is the pro-rate calculated on a 30 day month or just a 5 day work week. I am a Monthly paid employee and I would assume 8/30 or 8/23 would be the calculation. Also I was promised a bonus of $50 per unit sold for the month of October which was 25 which equates to $1400.00 what rights do I have and what action should I take?

Colorado requires that an employee who is fired be paid "at once." Regardless of your pay frequency or exempt/non-exempt status, your employer is not obligated to pay you past the last day actually worked, in this case Nov 8th. No laws dictate how your employer must calculate that amount - there are several different methods routinely used by companies for their salaried employees.

Also I was promised a bonus of $50 per unit sold for the month of October which was 25 which equates to $1400.00 what rights do I have and what action should I take? If this is a straight bonus, there's probably not much you can do unless you want to sue in small claims court and see what a judge decides. If this is a sales commission and you aren't paid, you can contact CO's Department of Labor and see if they can help you. It depends upon whether your State considers commissions as wages.
