View Full Version : Help please employer sent email about me to my friend

Hi, and thank you in advance for any and all help. My name is Cyndi and the proerty Manger for a gentleman I was working for sent an email to my friend( she had meet her briefly 1 time) in detail pertaining to a conflict at the workplace. I will be happy to forward a copy if someone can help me. Isn't that like a major violation of my privacy. She had threatened me with involving the police and in the email she named the deputy she had alledgely called and told my friend she didn't want to "Go There" but would if she had to. Isn't an employee somehow protected from this. Thank goodness she was good friend but this Mgr didn't know this in fact she knew I had been doing work for my friend since Kevin didn't pay me before he left so in essence she sent this to an employer of mine and it was no way no how related at all related. I am embarresed beyond belief and also very angry at her blantant attempt to I guess the word is slander my character, make me look bad and even implied I had stolen company property. Please someone tell me if I have any recourse

You have good reason to complain to the gentleman you were working for about what his property manager did but no laws were broken.

Aren't there some kinds of confidentiality laws that cover this? When someone calls for a job reference, it can only be disclosed the date of hire, the separation date and whether or not the person can be rehired by the company. Doesn't what this young lady say, in essence, fall under the same category? I believe there IS something she can do about this, including reporting this person to HIS or HER superior. Beth, I so hope you are wrong about some of these things you are saying, that, or I am in for a RUDE awakening at 40 years old! There could also be CIVIL actions taken against the person who wrote this about her to someone else..(provided, of course, there was some loss of job, financial security, resident, etc). I also know of a situation where a person was terminated for testifying in court against an employee he knew on a personal level (OUTSIDE the workplace)! There was NO appeal in unemployment for this individual, either, citing confidentiality laws.

There's a widely held belief that employers can only provide information such as you describe (dates of employment) during a reference check. It's not true. Employers can say anything as long as it's true. Because we live in a lawsuit-happy society, some employers have a policy of only providing the limited information that you describe for fear of frivolous legal actions, but it's that company's policy, not any law, that they are following.

In addition, if someone has a valid, good faith belief that you stole from the employer, they have a right to express that opinion. It only becomes slander if the information is false and the person making the statements knows it to be false.
