;) need advice on non smokers rights in the workplace. My company has a no smoking policy inside the building (retail store). However, several employees take many smoke breaks a day in the stock room. The non smokers complain, customers complain and complain. Indiana have any laws against smoking in public?
The only laws I can find with reference to smoking and employment are limited to the public sector. If you are in the private sector, it's up to the employer.
You can certainly find out whether your municipality has any laws regarding smoking within the building. The city where I used to work forbade smoking inside any building that was open to the public except in private offices, and even then only under certain circumstances. But that was a city-wide law, not a state law, and I wouldn't be able to check that out for you. Talk to your town hall or city clerk's office.
As one who is a non-smoker and mildly allergic to cigarette smoke, I am in sympathy with your problem. But barring a municple statute as indicated above, if your employer refuses to address the problem, the only thing I can suggest is that you stay out of the stockroom as much as possible./
