View Full Version : Vacation time and 2 week Notice

Hello,

I recently resigned from my former employer. My new employer required that I start in 1 week, so I was only able to give 1 week notice. During my exit interview I was told that I had earned vacation days and would be sent a check. This check never came, so I called my former employer to ask about the situation. They are now claiming that because I did not give 2 weeks notice they are not going to pay me for this time. The hand book outlines vacation compensation as a benefit, but does not say that it will be forfeited if a 2 week notice is not given. What, if any, are my options here?

Very few. Ohio law does not require that they pay out vacation time at termination. If they choose to, fine; if they choose not to, there's no legal action you can take because they're not required to do it in the first place.
