View Full Version : Employee File Requirements/Penalties

On October 4th I sent a request via certified mail requesting my employee file from my former employer. I worked in an office in Ann Arbor but the HR office was in Grand Rapids. After two weeks of no answer to my request (I printed copies of the delivery confirmation) I called and was told that while the Grand Rapids office had all the stuff that they had on file for me all set, the Ann Arbor office was dragging their feet in getting the bulk of the file to them.

Since today is the 31st day since my request was made, I am wondering when they are required to send me the file itself and what penalties they may face if they miss this deadline. Also, given that my request should have only involved printing/copying of records and thus could have been taken care of in a week I am very suspicious that they may be making changes to it. Am I within my rights to ask that the company provide me with a notarized statement that declares that the information is correct and that no changes had been made after August 31st (the day I was terminated)?
