:( I was in a bad relationship with my daughters father for about a year in louisiana and a half and finally left him in feb.04. After all of the abuse and neglect and his drug addiction and drugaddicted friends. I since got married to a good man in may of this year in west virginia. I want so badly to have full custody of my daughter so she won't be subject to him and all that he does. Can I do that? Can I file in west virginia or do i have to in Louisiana?

Most courts, when it comes to custody, would like you to file in the original state of jurisdiction. But if you have been residing in a different state for longer than six months, I would file a claim where the child has been residing if that is where you plan on staying.
