I was out on a non work related injury and applied for FMLA and was approved. This is for 12 weeks. My employer had me submit more paper work again to file for FMLA. Doctors office fax paper work to short term disabilty insurance company and the insurance company decided that I was by what they belived by there nurse that I should be off work and told me that I was to return to work. My doctor had not released me back to work pending more testing. After the furter testing was done the doctor released me back to work. But in the mean time my employer sent me a letter in the mail telling me that they had filled my postion. While my 12 weeks was not up on FMLA can they do this? This took place in KY. :mad:
