This is for tx workers comp. My spouse has been injured for 3 yrs, we have had 7 different doctors 3 of which were assigned by the twcc all agreed on the extent of the injury and % of mmi. Now the ins co had requested another mmi rating by a new dr. this doctor lowered the imparment rating from 15% on neck and 10% on shoulder to 5% on neck only 0% on shoulder. We are being told now that we have to abide by his dec. even though all of these other doctors have a differnt opinion. We also found out later that this dr has a practice with the ins treating dr!! I am so upset and I feel my hands are tied. We disputed his dec. the only thing that was done was that a letter was sent to him asking if he was sure he decided right??!!?
He stated that his dec was in corolation with the twcc review conference decision. In which he only address c 5/6 where as c 4/5 5/6 6/7 and 7/8 are all involved and agreed are part of the compensable injury. Please can anyone help with any suggestions on what we can do now. The way the ins co has handled things .. we have lost everything we had worked the past 16 yrs for.

Unfortunately, I cannot speak to TX WC, but I can speak a little for LA WC. At this point, I think you should see an attorney. It really sounds like you are being jacked around. If 7 doctors agree and one dissents, I don't see how they can exclusively rely on one opinion.

WC laws in most states limit the amount that attorneys can charge you, and it is a fixed percentage of what they win for you.

I met with an accident in 2001, consulted with several specialists for higher / average ratio of disability and follows-up. I feels happy,as most of them gave me higher degree of loss,but in 2003 I was sent for re-assesment by the insurer,my disability drastically slashed to minimum, WITH MY nature of casualities, I did not proclaim further,as I am recovering with times,(numerous follow up)also I fully believed that insurer have right for their second opinions.

I fully agree tht they have the right to a 2nd opinion too..but this would be the 4th 2nd opinion, 3 of thier own drs agreed and assesed the same if not higher opinion than our own. To me basiclaly it seemed as if we were sent around until they could find a dr that told them wht they wnted to hear. This dr that they sent us to, we found out later is known for making judgments with out looking at any of the med reports such as mris cts etc.
