I am an exempt employee who has 8 years with a Company and have accured many of of sick time and vacation time. This year I have used many sick days than normal to take care of my children, 10 years old and 20 months, and I have used vacation days. I have recently been written up for these occurrences and would like to know:

1. How FLMA can help, if possible,
2. Can the Company dock me for time off due to illness to myself or child as an exempt employee?
3. Must I use my vacation time if I am out of sick days?

1. How FLMA can help, if possible If either or both of your children have a "serious health condition" as defined in the FMLA, you will be eligible for leave time to care for them. There is a ton of information available on the web on the FMLA. I suggest you do some research or talk to your HR department about this.

2. Can the Company dock me for time off due to illness to myself or child as an exempt employee? Yes. (a) If you have exhausted a bonafide paid sick days benefit your employer has and are again ill and absent in full day increments, your employer may dock your paycheck; (b) If you are absent in full day increments for purely personal business (your child is ill), then they need not pay you for those days.

3. Must I use my vacation time if I am out of sick days? If your employer wishes you to, yes.
