How can I best collect lawyer fees from my ex husband? We are finally winding down after years of being in court regarding child support , arreage etc.- My next court date we will petition for the fees. If we institute a judgement, he will not pay- but I am responsible . Is there another alternative? (This is an interstate case). Thanks

I am not sure you would be able to collect attorney fees if this was a good faith dispute over the support and attorney fees were incurred. It really depends on the circumstances and how the state law is written. You can ask for him to pay, but it does not mean they will make him if the disputes were good faith and differences of opinion, which happens often in cases like this. If money is an issue, ask the state's attorney or child support division to represent you for free.

Thanks for your reply. The judge has ruled that we can petition for lawyer fees. Should this be approved, my concern is that my former spouse will not adhere to the ruling. Is there a way to enforce it?

Once the Judge rules that you will be awarded attorneys fee then you take the court papers to the credit bureau and they will put that on his credit record as being owed. Then if he tries to buy something on credit or sell a vehicle you will get your money. Also you could give it to a collection agency, I think. Other than that I am not sure what to do.

IF the judge ORDERS him to pay the fees, it will be a court order that should be enforceble through civil contempt proceedings. If he doesn't obey the order, file a motion for contempt.

If the order is reduced to a judgement, you can garnish his wages.
