I moved from Okla to Texas for my work. My wife and daughter are with me in Texas. My wife wants to divorce. We were married in Okla. I have lived in Texas for 6 months but I never wanted to permanently live here. My work is based out of Okla. My wife wants to stay in Texas. My family (and hers) is in Okla. My daughter is 11. She wants to be with me. My wife has told me that my daughter should be with me since I am able to provide better for her (she wants a new life). I want to go back to Okla. If I file in Texas will I be forced to stay here or should I go back to Okla and file for divorce there.

It is up to you. If you are still an Oklahoma resident, you probably can. But as a practical matter, do you have an address in Oklahoma. At this point, I suggest consulting with an attorney in Texas to see if you have been a resident long enough to file for divorce, but at t his poitn y ou may also want to see if the marriage can be reconciled. Yours is a difficult question to answer given the current ties to both jurisdictions and your intent to be and remain an Oklahoma resident.
