Possible age discrimination?

Here's the story, 55+ white female, employed at this company either part time or full time, for 20 yrs. No work issues/problems, good performer, good attendance. Was just given a 'pink slip'/termination notice which has 'reorganization' checked. There is no reorganization. They constantly have 'temporary' workers from outside agencies brought in to help out, so there's no lack of work. The manager kept repeating that the pink slip was HIS DECISION, there was no logical reason given.

What has been noticeable is the 'temps' brought in during the boss's tenure all fit a certain profile: young, cute, female, hispanic or oriental descent. It was disclosed that the 'qualifications' requests to the temp agency are VERY specific: non-English speaking, young, female. They are given less physical jobs, allowed to sit, and you know who got the physical, 'no sit' jobs. A complaint was made to mgmt, and it was OK for a short time, then resumed more than ever (maybe to try & force a resignation...or retaliation?). The feeling is when the 'subtle pushes/hints' didn't work, the pink slip came out. The worst part is being left w/no insurance (except COBRA), and having to go out into the job market as a 'mature worker' in a less than stellar economy.

There are other 'older workers' on other shifts. However, in this particular dept/shift, the work crew consists of the older male supervisor, and his much younger female crew.

What is needed to prove age discrimination?

You don't need to prove age discrimination. You have a valid reason to believe age discrimination has taken place - you can file a complaint with the EEOC and your employer will have to prove that age discrimination did NOT take place.

Just out of curiosity, what are the possible remedies should the EEOC find that age discrimination occurred? Is a monetary award the extent of the remedy? Could the woman be rehired? Other?
