View Full Version : Mandatory OT in TEXAS

Hello, first post here. My DH works for a company in TX and they have been mandatorying OT. No problem there, but they don't give any notice. They will tell him 1-2 hrs (maybe) before time to leave that they have to stay late or tell them when they are walking out the door on Friday that they have to come in and work early on Saturday. I thought that it was law that they had to give 24 hrs notice on mandatory OT? :confused: Sometimes they ask for volunteers but most of the time lately its mandatory. We cant schedule anything for our family because of it. :mad:

Also, a friend of his who works for the same company was working weekend shifts. 12 hr days, Fri, Sat, and Sun. and getting paid for 40. He went to go into work on a Fri. and his machine that he runs was broken. Instead of making him push a broom or put him on another machine or tell a temporary employee to go home so he could work that station, they sent him home for the whole weekend and they made him take his vacation time that he already had scheduled for another time. Can they make him do that? :confused:

There is no law in any state requiring ANY previous notice of required overtime. Although it is poor management in most cases (although sometimes, it really is that unexpected) it is not illegal.

Regarding your friend, assuming he is a nonexempt employee (since he is "running a machine"), there is no legal requirement to pay him for any hours except those that he actually worked; and there is no minimum "reporting pay" required in Texas.
