My daughter is 19 yrs. old and is a freshman at UAB. My ex-wife who resides in Mobile, AL has when back to court requesting an increase for child support for our daughter and to continue support payments & insurance. I contacted my ex-wife and asked why? I had no intentions of stopping support payments for my daughter, however, my ex is requesting an increase based on my income. I asked my daughter if her mother has given her the monthly support checks. My daughter has informed me that her mother has not. I have sent my daughter addition support monies each month. My monthly salary is $5000.00 before taxes and deductions, however, due to work demands this year I will gross over $100,000 for 2005. Our court date is 1/30/2006. I think it is un-fair to calculate any possible increase above my monthly base salary, because I am not guaranteed over-time. If the CS judge rules in favor of my ex-wife (Gross Income), then He/She has the ability to look into the future and know my yearly gross income. If that's the case why don't they tell my ex-wife a winning lottery number. Can I file to Emancipate myself in AL or have my CS payments go directly to my daughter rather than her mother. I will not support my ex-wife house hold!
