Me and my friends just got out of a club in Toronto, canada after celebrating one of my friends' birthday. We were exiting the parking lot when one of my friend's cousin (which is not our friend) pulled out from his parking space and and was on our way. He was driving a kia, which is not his car (that car was from chicago, the birthday boy's best friend. He insisted driving that car because the owner doesn't really know the way around toronto) My friend, who's driving a honda, couldn't brake in time because we were too close and ended up hitting the front-driver side bumper of a kia. He backed up and we left because we were all going to the same restaurant anyways. We we got in the restaurant, we saw that the honda's bumper was dented and it was falling out. We told him that it was his fault because we had the right of way. He refused to pay, saying that we left the scene of the accident. We were furious. He was ready to call the police but we found out that the kia didn't have insurance and they had drive back to chicago the following morning. Do we go after the driver, who's from toronto or the owner of the car?? Who's fault was it??

Sounds like you all are at fault in some proportion if you hit him and if you are more than 50% at fault, will be liable for damages. Not having the car properly registered-insured is a matter for the authorities so if they were not called that night, it becomes about damages so it is who can present the case best with evidence and proof. Consult an accident attorney.
