View Full Version : Accident in parking lot,driver lying.

My car was parked in shopping complex parking lot; my child about 10 yr old was in the car, I was not in the car. Other driver hit my car while trying to park his car. My child, who was in sitting without belt hit front seat, was bit in shocked, another shopper who saw enquired and arranged to make announcement in the shop for me. I came out, after talking to other drive who seemed quite polite, said sorry we exchanged information, the other gentleman (shopper who called) asked me if everything is all right, I said yes and did not take his name and phone.
Now other driver requested that he would pay for damage repair and not to go to insurance company, I agreed, as damage was minor on bumper. After going home my child was crying complained pain in hand and dizziness. I thought it was just shock and he is frighten. Next day he was still complaining So called hospital, advisory nurse told to take him emergency room, there after examination they told nothing major, asked for applying ice and some pain killer for couple of days and he should be okay in few days. I could not take my car immediate fro estimation, after couple of days I took to one repair shop that usually does insurance repair, they wrote estimation about $ 500, after sending this estimation and my medical co-pay receipt to other driver he did not reply called 4/5 times and left voicemail finally he called back and replied but was not ready to pay. Finally I called insurance company, other driver lied to his insurance company that I was backing of at the same time. Since damage is same as my deductible my insurance will not follow up or do anything about it, they suggested I could go to small claims court. What are my options? Is lying criminal case or civil? Can I file police report?

Should have gotten a police report at the time of the accident. If it is not an inusrance matter, then you can sue in court on your own but you may also need to sue your insurance company also for their lack of covering you if they were supposed to. At this point, I suggest you consult an accident or injury attorney as they may be able ot assist you best since you have the other driver and possibly your insurance company to sue.
