I need some help. My wife works for a pre-school, the owner of the pre-school has two schools, similar names. My wife often works betwen the two schools, a few hours at one and a few hours at the other to cover for teacher shortages. The owner pays her with two separate checks because she claims that the two business are separate. Her hours total more than 40 hrs per week but she is not being paid OT. Is this legal??? :mad:

No. Companies under the same ownership or control are treated as the same employer for purposes of hours worked. However, she would probably have to file the complaint for unpaid overtime with the Federal Dept. of Labor, rather than Florida's Dept. of Workforce Innovation, as Florida defaults to federal laws on this issue.

Just call the federal DOL.
