I was injured during the course and scope of my job this past week. I have been assigned to a W. C. rep. They have approved me for surgery tomorrow.

I am not real certain what I am entitled to. It's been made clear to me that my medical bills will be paid, that I would actually be reimbursed for travel to and from the medical facilities. 2 questions.

1. My W.C. Carrier explains that she can only pay 66.2/3 % of my salary while I am disabled. I have almost 3 months of sick time accrued, which if used, would pay me 100%. The way it was phrased is that I don't have a choice. As it was work related, I cannot use my sick time, have to use w.c., and lose out on 33.33% of my wages. Q: Is there any way that I can be fully paid my salary through the sick time while I am out?

2. My understanding is that you can actually be paid for the injury itself based on a pre-determined schedule that is used. The schedule mainly is effected by any permancy/disability rating. I tore my dominant hand bicep tendon. I am not certain that I would get any disability/impairment rating. If all goes well, I am hoping that I am back to 100%. Am I entitled to any payment for the injury itself over and above the medicals?

However if your employer is subject to the FMLA, you qualify for FMLA, and your employer is attributing this leave time to your FMLA entitlement, then you have the option of taking your paid sick time while on FMLA leave. This gets a little tricky but I suggest you discuss this with your employer and first determine whether the FMLA (Family and Medical Leave Act) applies.

You don't get any sort of "bonus" simply for being injured on the job.
