I took a job with another company and have been there a year now. I realized it was time to do something about my carpal tunnel. The carpal tunnel came from my previous job. I did see a doctor about it 5 years ago while I was working at my previous job, but I did not go back to my docter as the company would not let me move to a different job I had singed for because they said I could not do it with having carpal tunnel. When they realized I stoped going to the doctor they let me move to the new position. I actuall tryed going to a chiropractor(which did not work), but I told them not to put it under being work related as I did not want the company to know. I stoped going to the chiropractor and worked there about another 3 years. By the time I realized my hands were really getting bad the company was laying people off and I did not go back to a doctor from fear of loosing my job. Now that I had the surgery done can I claim workmans comp and get my previous employer to pay for it??

Well, you can certainly try but whether your former employer will be liable for your surgery given the amount of time that has passed, that you must have gone on record with a number of the medical providers who have treated you that this is not work related, and that you are bringing the claim post-surgery, the odds are certainly against it but on the other hand, Wisconsin's Supreme Court has made some darn ridiculous WC liability decisions in recent years so who knows?
