:confused: hey I steamed in illinois ...My step son was to graduate in june of 05 but we found out in april of 05 he drop out of high school in jan. Don't get me wrong their was long disscussions and heated talks about him dropping out and her hiding it form us but as it always happens in our houses she and he wins. So the exwife started a Petition to Modify, suspend or abate order for support in April. She filed it wrong the first time, but on june 21,05 she filed it correctly at the courthouse, we have been waiting on her to get a court date with a judge. Her last excuse is she is to depressed because she lost her job, this is reason number 4 of why she has notdone it yet. Is their any way we can take over this process without getting a lawyer and his fees included? Thanks

Of course you can. You don't have to wait on her to have the child support modified or terminated... it's not even technically her responsibility to do so. I would contact a lawyer for a free consult. Also check with the courthouse to see if anything has proceeded or if it's even still an open case. If not then file on your own.

IF WE FILE AN ABATE ORDER WILL THAT ALSO STOP THE VOLUNTEER ORDER WE STARTED TO PAY THRU THE COURTHOUSE? We had to start this because we would pay her and she would tell her lawyer we did not and we would go to court with our cancelled checks and this just cost us more fees. So in the long run we thought this was the easy way to have proof every week. :confused:

If you file to terminate support it will stop all payments.

This is a perfect example of how greedy ex's keep taking what isn't theirs!!! This mother is probably freaking out that her ex isn't going to legally have to take care of not only his son, but her, anymore. Oh my God, how will she live?? Oh my God, she might actually have to watch her spending for the first time since she got divorced, or get a job. I am so sick of this whole child support thing!! It is so unfair!! Thank God that your nightmare is almost over. Most of us have years left to pay!!! I envy you...
My husband's ex was having his checks garnished for $800.00 per month, and his daughter wasn't even living there with her anymore. The mother let her move in with her loser boyfriend, and kept lying to us whenever we would call and she wasn't there. When their daughter finally ended up pregnant (at 15), she contacted us to see if we could take her because she just couldn't handle her anymore!!! UNBELIEVABLE!!!

:eek: Yea, her excuse why she can not get a court date on monday(today) is she has three job interveiws. I geuss someone in that house is going to have to start working. The sad thing is the house they live in was given to her when her father pasted and she got a little money too. Since then she has just lived our money. And when it was not enough she knew how to work the school district they lived in (not the same as ours) she would send him to school in winter with shoe with holes in them and the would call dad and ream him a new one. Or with no winter coat even though we buy him one , she take it back for the cash. We have seen it all she take back birthday gifts and Christmas gifts for the cash and any school clothes she take them back for cash and he be without. So we paid support and paid for all the extras and that is the begining. At 19 he stills holds his father responsible for leave his mother to be alone. Now tell me there has not been some trash talk in that house. O don't get me started I could go on for a week but right now I trying to stay focused on stopping child support. Hang in there I know it can be a long road and it can be the bumpest road you will ever ride but you can do it.

File to terminate support with the court that has jurisdiction over the support obligation adn ask that your case be consolidated with the mother's case. That may help you get a court date faster.
