View Full Version : Whitholding Final Paycheck 30 Days in Georgia

I am a commissioned mortgage loan officer whose former employer is withholding my final paycheck for an additional 30 days. Normally we are paid for a previous month's closed loans on the 15th of the following month. My former employer is holding my check for an additional 30 days because they say they need to reconcile the appraisal invoices to insure that I did not order any appraisals that were not paid for by the loan closing or by the borrower themselves. The research to determine this could be done in an hours time. What recorse do I have to make them pay me sooner? Also if they do not pay me for another 30 days am I entitled to any damages for incurring late fees and potentially damaged credit? For the record I do not owe for any unpaid appraisals.

Unfortunately, Georgia one of the few states that does not have regulations regarding when an employee must be paid following termination (or at any other time, as a matter of fact). So the only way you could get this resolved is probably to file a civil suit. If the amount falls below the state small claims maximum, that would be the cheapest and easiest way to go. You could include a claim for late payment and see if that would fly.
