View Full Version : Father In need of advice/ Pls !!!!

I live in North carolina ,me and my wife had seperated about 15 months ago , because of my job i was working from 7:00 am until 9-10:00 pm every day . I did this for about 2 yrs and thought i was doing good for our family . My wife and 2 children. So at a certain point i found out that she was having an affair with 2 of my friends and a guy that she met online (NO JOKE ) because she was tired of being lonely, I worked relentlessly for our future. OK so when we first seperated i moved out leaving her everything and taking only my clothes . I gave her money each week for gas , cigs, food , rent , electricity ,and so on and so forth , about four months of this and i found out that she wasnt using the money for those things she was buying drugs for her and her new boyfriend , I stopped giving her money then . No i didnt get any recipts either , Anyways So she picked up and moved to another state with her new boyfriend for about 8 months , This happened after she had let every bill go so far that all the utilities got turned off and the landlord kicked her out. SO, now she is back in NC ,she came back in febuary and filed for child support aginst me and didnt tell me . somehow she went to court on april 15 and had me ordered to pay child support to her in the amount of 537.00 a week . .....a week ... Ok well i wasnt aware of the court date and didnt attend because i was never notified of it . So now its october and she has started calling me and telling me that i was ordered to pay and now im very behind and im going to jail and that she has been calling the dss to have me arrested every day for the past 4 months now . AND I STILL HAVENT BEEN SERVED WITH ANYTHING SAYING ANYTHING ABOUT CHILD SUPPORT. Ok so now i want to go to the dss and try to get this straightened out and i want to provide for my beautiful children but im scared that im going to be arrested if i go down there . what should i do about this . can anyone help me ..pls

I don't thnk you will be arrested. Get an attorney right away and have give him or her the information you have. Did your ex wife know where you were living? If she did then you can show the courts that she knew where to send papers and did not and request a new hearing. Your attorney will help you with this. Do this quickly so they will know you want to to do the right thing. Good luck!

Wow, what a mess. The first thing you should do is make an appt. with an attorney. Then go to the courthouse and look into the file, get a copy of the court order, and make sure to check to see if there is ANYTHING in the file that shows that you were served any notice of a petition/motion.

Unless you are making VERY big money the $537.00 a week sounds steep for 2 children. It is POSSIBLE that the CO has a clerical error, and that might be the monthly amount, not weekly.

You can try talking to Dss, but before you do, make sure to look at your file first, if a warrant has been issued as your wife claims, it will be in the court file. If you talk to them be sure to point out to them that you have never recieved any notices of any kind. My personal advice is that you speak with an attorney before talking to DSS. Good luck.

Report the mother to DCF as she is a drug user, let them get the kids away from her, and then put the kids in your custody and care. Given this situation, it is dangerous for the kids to be with her and her boyfriend who uses drugs. Support and custody are separate issues for courts. Also, you shouldeb able to call down to the court to see if this is for real and if it is, you need to respond to let the court know that you never received notice and seek custody of the children immediately because of the mother's lifestyle being a serious threat to the childrens' well being. Consult a local attorney, even if it is just going to free consultations to better understand what to do.
