I was fired from my job as a receptionist while i was off for a week due to mental illness with note from physician. Do I have to wait for the regular payday to come around or since I was fired do they have to give me my check within 2 days? Thanks Chris :confused:

Kansas requires that final wages be paid no later than the employee's next regular pay day so no, they do not have to give you your check within two days.

I was fired from my job as a receptionist while i was off for a week due to mental illness with note from physician. That's a rather leading statement and it's possible your employer may have acted unlawfully but you'll have to explain your situation further if you want any comment on that. For starters, how long you worked there, how many employees they have, whether you've taken any other medical leave time, and so on.

I just made 6 months and it is a very very large company all over u.s. and I was just diagnosed as bipolar and we were trying to get med's right. However, Ks is a "don't need a reason to fire you state." they made the comment when firing me that it wasn't due to performance it was absentism.

Since you were only there for six months, FMLA does not apply and it is legal to fire you for excessive absenteeism, no matter how legitimate the need for medical leave.
