View Full Version : Employers Responsiblity for Commission Payment

I am in the state of CA. I have been employed for 4 years with current company and considering leaving. When I first started working for the firm, I was paid a base salary with bonus/commisison. Over the next few years during the employment, the company has taken the salary away and is now paying me commission only. I provide rental services and in addition to new business, I have reoccuring business that the company pay's me on -- against the total billing for the month.

If I leave the company -- what is the responsiblitiy of the company in paying me commissions on revenue still being generated by my sales efforts, AND -- I have signed contracts for new business in the next coming months?

In California, my experience is that earned commissions are considered vested wages which must be paid at termination, or as soon as the amount can be determined. Relative to contracts in progress, it would probably be a good idea to have your commission plan document/agreement reviewed by an attorney.
