I currently reside in Ohio. I have 3 children. I have full legal custody of them. Upon notification of my intention to relocate back to Florida, custody motions were filed for custody. What grounds do the fathers have to take my children from me. Would the courts actually decided to rip our family apart because of a move? There are many details here but bottom line, the burden of proof lies with them. The best interest of the children are the real factor here.

The courts tend to look at the best interest of the children to have a relationship with both parents and a move can prevent that. You are going to have to prove that the move is in their best interest showing there is a reason to move that will better their lives. Where does does dad live? Does he exercise visitation rights currently and how often are they?

Many judges view relocation as ripping the family apart.

Even if you have sole legal custody relocation is considered excellant grounds for a change of custody with the other parent having a good chance at winning and you being left with the choice of move or being relegated to the place of non custodial parent. surely there are many other points that will be considered but if the ncp currently excercises his visitation there is a very good chance that he will recieve a ruling in his favor unless you can prove that the move is in the best interests of the children.

The fathers do not want the kids to leave the state because it would make vistiation harder and maintaining a relationship harder. If you can articulate that it is in the best interest of the children for you to remain the custodial parent, you should be ok. BUt I suggest seeking counsel to represent you in court. You also should have a reasonable reason for wanting to move with the children.

Just have faith angelah. legal matters can always be dealt with. i know that for some reasons like things you are in now has a purpose and according to God's Will. Just trust and Pray to him. About your children, if you decide to move to other place, i just want you to remind for the safe ones and good schools to attend.
