does anyone know the answer - i don't have a lawyer yet and don't want to have to pay alot of $$ to find out the answer. if i get sole custody of my 2 kids and I make more money than my husband, does he still have to pay child support? Would I have to pay him anything (maintenance) since my salary is higher?

No matter how much one makes the NCP will pay SOME sort of support whether it's minimal or not. Maintenance depends on a lot of things like the length of marriage, and things like potential to make a higher wage.

Oh and to add... Sole custody isn't all it's cracked up or sounds like. Sole custody does not mean that the other parent has no say or no visitation. Nor does it mean they don't have to be informed of things or be given any sorts of rights.

i understand all that, however it amazes me how a father who has shown indifference in all matters related to his children's upbringing, schooling, activities, healthcare, religion, etc. while we were married, but now that we're splitting why would he all of a sudden show an interest in his 2 great children. I really want sole custody with supervised visitation, but I figure it would just be easier to go for sole custody.

I guess the question is what you think 'sole custody' will do for you? And you're right, without proving a need for supervised that's likely not going to happen either. It does happen quite often that parents who don't realize what they are losing til they are gone start showing more interest. Doesn't always make it seem fair to you, but it's the kids who benefit from the involvement, and that's what matters.

maintenance is usually divorce related; the fahter will likely have a support obligation to the children based on his income; This sounds like it is a divorce that will also include custody and support matters. You should consult an attorney and discuss the strategy for both maintenance, custody and support, since all matters of these natures are approached separately
