I'm in va i just got custody of my daughter. can i go to child enforcement and stop support on her; even though the mother still has my son. I have joint physical custody of my daugther. :confused:

I have joint physical custody of my daugther. :confused: Ok.. I"m with you now.. you each have a child. So, the answer sort of remains the same. You need to go to court and have it modified. BUt, just to note, just because you each have a child doesn't automatically mean there is no support ordered. Basically unless the two of you agree on something (and make sure it's in writing and signed by a judge to be completely legal) then likely the one with the higher income will pay the other at least a minimal amount. When you got custody of your daughter the support should have been modified at that time. If it wasn't, it appears on paper that the original amount is owed, so you need to get that modified. elklaw 10-12-2005, 08:10 PM Sounds like you have joint custody in terms of making decisions, but the mother has primary physical custody so you still pay child support |
