If an employee receives higher pay for the same type of work that your pay can not be decreased but your pay must increase to equal theirs. An employee's pay certainly can be reduced as long as it is not for a specifically prohibited reason. No laws require that every employee doing the same or similar work be paid the same. The EPA and Title VII simply require that those differences not be based on a protected characteristic. BLinKY 10-20-2005, 01:47 PM If you are working in the same conditions as your co-worker and doing the same type of work, that is what the Equal pay act states. However anyone wants to read into it... From my understanding of this states that I can't come into your work and work right next to you, doing the exact same job (etc.) as you and get paid $20.00 per hour when you only get paid $10.00. The only exclusion to this is, that it is not discrimination if my qualifications are better. If I went and got a degree in "Accounting" and my job is "Receptionist", I should not get a higher pay because I have an Accounting Degree. Because Accounting does not have anything to do with being a Receptionist. Maybe I did mis-understand what the Act states. I'm just giving an idea of where she might go to get facts. Beth3 10-20-2005, 01:59 PM Blinky, you do not understand the Equal Pay Act. (I'm not trying to get into an argument with you, just trying to clarify your understanding of that law.) For example, it is perfectly legal to pay one machinst $20/hour and someone running an idental piece of equipment with identical skills $10/hour as long as the reason for the difference in pay isn't gender, race, religion, national origin, handicap, or some other protected characteristic. |
