:confused: I am a grandmother of a 2 month old baby girl..My daughter is 19 and was never married to the father..The father nor the grandmother had anything to do with my daughter while she was pregnant..and both wanted her to get an abortion..When my daughter would talk to the father he stated many times he did not want his mother around the baby..nor did he want her there for the birth..The father was 2 hours late to the hospital, has visited the child 4 times, paid $43.00 in child support, threatened my daughter if she filed for child support..been in jail 7 times, does crack cocaine. We have not heard from the father in about a month but the grandmother is very upset that we do not make time for her to come see the baby..She is unpredictable just like her son..and had made comments that she will get custody of the child..We sent the child suport papers off and with them I wrote a letter on how the father is and sent a copy of the journel that I have been keeping of the father..Do you think this is going to be enough to keep the father away or just visits with supervision?..Also the grandmother supervised visitation rights? I have been told to call child protective services to let them know of the father and the way he is and that we do not think the baby should be around her..I just don't know..Can we leagally keep the grandmother from her right now?..I am scared she is cooking something up with a lawyer..These are the type of people that the baby does not need to be with without supervision..What are our rights?

I suggest that the mother file for and seek sole custody of the child, then if you all can afford it- move away from the area. Or maybe just move away to another part of the state, then file for sole custody and termination of the father's parental rights. She may even want to ask that the father's parental rights be terminated given his record and incarceration and abandonment of the child. As for the grandmother, she may pursue grandparent visitation, but not sure how that would be if the father's parental rights are terminated and given her history. It sounds like you are dealing with unstable people, so I suggest getting away from them for your own sanity. Texas is a big state. And if you do not see the father ever being there as a decent father, you know he will never pay any support, so just ask that his parental rights be terminated and that should be the end of it. There would be no obligation to stay in touch with the grandmother.
I suggest consulting an attorney also.

ps. You would get no support if parental rights of the father are terminated, but it does not sound like you are going to get any support anyway, so it may be best to face this instead of seeking support that will keep you linked to the threats of a man and his family for the next 18 years.

Can all this be done at the child support hearing or do we need to get a lawyer...?..We are getting things together (evidence) of what he has done for this purpose..
