Hi, my ex husband already owes $13 thousand in back child support. I have been in contact with the prosectuter in Indiana. I wasn't getting anywhere they told me that in June they put in a garneshment but I have never seen anything. October 25th will be a year sence he has paid anything at all. The other day i called the prosecuter again and she called me back and said that he got 1000 days in jail for probation violation. ( For something else) Is there anything that I can do to get anyhelp from the state sence he was not put in jail for support? I don't know what to do... :confused:

Since Dad is going to be in jail for the next 3 years, it is doubtful that you or the prosecutor can do anything until he gets out. Does he have any trust fund, etc. that the CS could be taken from?
Basically, while a NCP is in prison CS cannot be collected, however, he is still being charged with support for the time he's in jail. And all of it will have to be paid later. Sorry.

Can you get help from the state. There are many programs to help you. Check them out. There may be rental assistance, food stamps, financial support, help with child care expenses, etc. Good luck. What a yucky situation.

No he doesn't have anything. He has just wasted away anything and everything that he has had.

he is in jail and not making any money to garnish so it seems you have no avenue of redress

I am not sure if he is on work release or not, i know when he was in last time he got work release but they still didn't do anything about him paying support. Thats when they got the garnishment in June.
