gave notice the first week in Sept. and my last day was Sept.30. I had turned in a vacation request for the Oct. 3-7 to get the last of my vacation time. My boss signed off on it and all was good. The problem is that through the month of August and into the first 2 weeks of Sept., I did major overtime of 80 plus hours. We are suppose to get comp time for overtime hours. When we slowed down, I started taking days off before the end of my notice time was up. When I ask about my vacation pay, I was told they could not pay it with my last check because of quarterly numbers. Call us on Monday and we will try to get to you then. OK. not a problem. Called Monday and was told I wasn't getting my vacation pay because of the days I took off during the 2 wks. and I told them those were comp days for overtime. I took 4 days in that period. I have a copy of my vacation request which my boss signed. Is this legal for them to withhold after they agreed to my vacation days?

I'd want to see the comp time policy before saying yes or no. But Florida law does not require them to pay out vacation time at termination or allow you to add vacation days to the end of your employment.
