I live in a but I am hav e to collect my unemployment benefits from NYS because i did not have enough quarters in ga to collect. GA is a employment at wwill state and I when I was terminated they gave no explanation of why only that i was being separated from service when I applied they for benefits they contested saying I was fired for being on the internet excessively but i also was given a evaluation on the day of my separation of all satisfactory work, no need improvement or anything I was a legal secretary for Child support. I signed a form in the begining of my employment saying that u can use the internent what is considered excessive and will i be eligible for my unemployment since i was never reprimanded for usage or told that is why i was being fired infact they told me they didn't know why. can they use this now as a excuse not to pay me and can i fight it in appeal.

What is considered excessive is up to the company. The law doesn't provide a standard.

Whether you will be eligible for unemployment will be up to the state.

Your employer does not decide whether you do or do not get unemployment. They are free to contest if they feel you should not be eligible, but the state will make the decision. IF your employer wins, you are free to appeal but I have no way of determining whether you have any chance of prevailing.
