I work in TN - I am the solely employee in TN- My home office is in GA - More than 30 employees. The company overall has 150+.
I have worked at my company for 3 yrs. Just yeterday my company says they are going to either give me the choice of a Commision Sales structure or a Severence package. This consist of either choosing to go Full Time Sales or they will close my office "down" and I will be without. I am 4 months pregnant. I have prior business and I have made money from the customers I have in TN for my company. It will be hard for me to find another job - especially being pregnant and also for compensating a $55,000 year job. Especially since they are only offering me a commision structure - That is taking away from my salary I make now.
My questions are - Do I have any kind of case against them for the layoff/fire.
Since it is a "pre existing pregnancy - How does that work?
They have offered me transfers to ATL or DFW - Why couldnt I do this from my home (there ARE employees presently that work out of their homes)
What kind of severence package do you think they owe me?
Do I need to get involved with a lawyer?

You cannot be laid off because you are pregant. You can be laid off in spite of it. If they have a legitimate business reason for making these changes, then the action is not discriminatory. You haven't posted enough information for anyone here ot comment on that. On the face of it, there could be very good reasons for closing a one-woman outpost and moving that person elsewhere.

Unless you have a contract stating otherwise, there is no law that compels any employer to offer severance pay. You are certainly free to negotiate the best severance package you can get, and you may want to consult with a lawyer before signing anything.
