I have filed for workers Comp. for two different injuries. One was from june 2005 and the other one is from September 2005. I found this worker's comp. attorney a little over a month ago for my first claim and then told this attorney of my second injury which is related to my first injury. Anyway every time I call him he says that he has not filed my claims yet as he states he has been really busy. He says he needs to send me paperwork for my second claim but is taking his time doing it. There seems to be a time limit for everything that is filed and I am scared he will not file my paperwork in time. Am I just being impatient and should I put more trust in him? Thanks

HI,

You might want to call your regional workman's compensation board, depending on where live (State, City) and speak to your WC Examiner. Every person is assigned an examiner with each case, whether established, in appeal or extended. If you don't have access to you WCB # they'll still be able to help you (need SSN). The examiner can see your file and work with you on what you need to do. In some places you can access your information at your local WC site (usually at City or CountyHall's where cases are heard).

I had a lawyer who basically lied to me as to what he was submitting until I became aware that an examiner was available. I found out that he hadn't filed anything yet was telling me that he was for close to 8 months! I have since learned laws, rights and how to file appeals. Research is good.

Do it as soon as possible. The statute of limitations is usually 2 years.
