I am an office manager of a small business in texas and we have a few questions on Overtime. We have abunch of subcontractor guys working for us, and is it true that if they work over 40 hours, we do not have to pay OT. Does the sub have to sign a contract or something? If a worker that has taxes taken out of their check, if they make more than 40 hours, we have to pay them overtime, correct? Thanks.

If the workers are properly classified as independent contractors, then the terms of the contract should mandate whether or not overtime must be paid. If taxes are being withheld, you are obviously treating the worker as an employee and, as such, the worker is covered by all applicable wage and hour laws.
