I am almost 3 months pregnant. Missing a lot of work because of cramp pains and back pain(not light ones bad ones to wear i can't stand). I have been to my doctor 3 times now, and some other doctors. I have had lots of tests done. Still nobody knows why the cramps, the doctor can only say probably because my baby is sitting way too low. Last week i went in to the doctor and the baby moved down lower. I work in South Dakota. My manager wants me to go in and fill out a leave of absence for medical reasons. If not they are probably going to fire me soon because of absences. ..You are only allowed 6 missed days in 6 months. .and this pregnancy is so going so well since i was 2 months along. Am i eligible for unemployemt if i take the leave of absence my work wants me to go on until i can comeback. I don't have any insurance with them, i have my husbands insurance. I have been trying to come in but work has sent home a few times now because of my pregnancy? Would i need papers from my doctor to the unemplyment agency???

1. How long have you worked for this company?

2. How many employees do they have in total?

3. How many employees do they have at the site at which you work and within a 75-mile radus?

I work at Wal-mart. I have been there for over a year. The company i work at has at least 400 or more employees, this walmart is suppose to be number 3 in the world for retail and sales. The closest other Wal-mart is an hour away. My manager wants me to take mediical leave. I cannot lift and carry ladders and stand for more than an hour at a time without having to sit. I am running to the bathrom a lot. Basically my baby i am carrying now is sitting low. My doctor said as long as i am not bleeding i am ok right now. My cramps are bad and in my back as well. I think work is just going to want me to leave.....

Your manager's request that you apply for medical leave is quite reasonable since you are unable to perform a number of duties associated with your job. If you refuse to take leave and refuse/are unable to perform all your customary job duties, then you will leave your employer with no other option but to fire you and that's not a good outcome.

You can't lift, you can't carry ladders, you can't stand for more than an hour and you are frequently away from your work station to use the restroom. Assuming you are a store clerk, it certainly appears to me that you are disabled from performing your job at the present time. Apply for leave and whatever disability benefits your employer offers. I don't mean this to sound harsh but your employer does not have to pay you to come in and sit around, unable to do much of anything.

I agree, about me leaving there. I am sur i could find a job that lets you sit...my old job gave me a chair at rhe register when i worked at a groccery store because bad knees run in my family, and i had to had therapy and crutches, etc. I work in shoes and jewelry at walmart. So i an talking to my assistant manager tomorrow, and they will probably let me go. I know cell one, sams club, desk jobs,and my friend is leaving her job next week her on base, all she does is make calls.....i am sure i can find something to suit me for now until i stay at home permanently with my 2 kids. thanks for all your help..
