Well not sure if I am asking in the right place but here is what is going on. A few years back My wife hurt her back at work. She did make a report but no time taken off from work. over the next 2 or 3 years her back keep getting worse for being on her feet all day. In the past few months she has had to take time from work to try to get her back healed. The other day she was asked by her boss to help him lift a heavy box about 75 to 100 lb her boss knows of her back problems but asked her anyway. now her back is hurt bad and now works comp wants the date and report from her 1st injury and her job will not give her a copy of report or the date it was made. Workmans comp is saying they will not cover because her back was bad before and she cant prove that she made the 1st report. What should we do and is there a law that should of stopped them from ask a women to lift something that haevy. do we need a lawer

It sounds like you need a lawyer and may need to get a court order or subpoena for the first report to be found. Another possibility is to get affidavits from the person who handled the reports. Your wife should also check her records and personnel records to see if a copy of the report is still there.
