View Full Version : I quit, and they are still paying me.

I faxed a letter of resignation to the central office of my south florida employer, it was accepted, and I left in the middle of a 2 week pay period.

I have just looked at my bank account, and they have deposited a full 2 weeks salary into my account.

What are my legal courses of action? I would of course like to keep it all, since they made no mention of paying me for my unused days off, sick days, etc.

Of course, you would like to keep it all. But legally, it's not all yours. The employer is not required by Florida law to pay you for any accrued vacation or sick pay. However, the company may have a policy to pay either (although payment of accrued sick pay at termination is rare).

They will find the error at some point and want the money back. And you would legally be obligated to pay it back. And they could sue you if you don't. And they'd win.

Why don't you just call the company and find out what is going on?
