Hi, it is me again as my place of employment is a real circus as they violate everything that they can and they seem to get away with it. The manager of the office made all of us at a unit meeting post our religion and what sign we are. He did this for everyone to see. A few of us felt very uncomfortable with this. I complained to Fair Housing and Employment who sent me a right to sue letter but also closed my case and forwarded it to EEOC. EEOC says that right now it is going through mediation and if the employer (State of California) does not reply that an investigator will investigate and that my employer has until October to reply. Why would Fair Housing send me a right to sue letter and then close my case and forward it to EEOC. If it is going through mediation, does that mean EEOC has accepted my case? What happens when it goes through mediation and then what happens after it is assigned to an investigator? Please advise. Thanks a lot.

The manager of the office made all of us at a unit meeting post our religion and what sign we are. So, for example, employees had to post "Presbyterian/Aquarius"? Geez, Louise.
Why would Fair Housing send me a right to sue letter and then close my case and forward it to EEOC. I have no idea except that in a number of States, discrimination complaints filed with the State are automatically cross-filed with the EEOC. Typically, the EEOC then waits to see what the State determines before doing anything. You may want to contact CA's DOL and ask about this.
If it is going through mediation, does that mean EEOC has accepted my case? Yes, but it does not mean that they have determined discrimination has taken place. Mediation simply means that they're going to see if the parties involved can resolve the claim between themselves. If they can't, then the EEOC will continue with their investigation and eventually make a determination.
BTW, having employees post their religion and astrological signs is really, really stupid but it's not discrimination unless it results in any adverse employment action against any employees or harassment due to anyone's religious beliefs.
