If two of my co-workers flirt and the female co-worker states to the male co-worker, let's go back and make a baby plus she rubs his arm in a sexual manner and she sits on his desk with her legs opened wearing a dress while she is talking to him, and it is always done in front of me as I see this as very offensive. Is this sexual harassment? I know it is not directed at me and it is involving a third party but it is very offensive to see and hear this all of the time.

DEFINITELY!!! Comments need not be made to you, for you, or about you. If you see it or hear it, and indeed it sounds like it is offensive to you, then yes, it is sexual harassment. What I would do is ask the employees to stop because it offends you, and I would report that to your immediate supervisor. If the company agrees to back you, then it ends there. If not, get an attorney. That is disgusting.

One correction. The next step is not to get an attorney, but to file a complaint with the EEOC. A lawsuit for sexual harassment or any form of discrimination CANNOT be filed until or unless the EEOC or the equivalent state agency has issued a right to sue letter.

Hi, Thanks so much for responding. I have asked them to stop and have gone to my immediate supervisor who does not care if this is going on or not. As a result of complaining about this and other issues I have been retaliated against and mandatory transferred to another office much further from my home than my original office. I have been going to EEOC and even went to Fair Housing and Emolyment about another issue who gave me a right to sue letter. There is every kind of discrimination going on in this office as this in one way of pushing me out to either transfer or quit. They have done this to people before me and because they get away with it they become more powerful and more illegal. I am still trying to find out what my rights are as I cannot afford to hire an attorney. I can only try to get one on continguency and this does not look good even though they all claim I have a very strong case. I start a new job on the 11th but still want to pursue this as because of them, I had to seek another job within the state. Any and all advice is very much appreciated. Thanks

Once you are issued a right to sue letter, you have 90 days to file a lawsuit. If you don't file one within that time, you are forever barred from doing so.

GENERALLY SAID, conduct of sexual discrimination ,requests verbally,physical nature,materials or direct physical contact,touching,patting,pinching,brushing-rubbing,assault ,suggestive gesture-manners..,which unlawful,unapproprite behaviour,lower morale which interfere-work effectiveness to contitute of misconduct. normal or sounded beings, will never shown such manners - openly,the acts either purposely by themselves or third party involvements,to lure or attract anyone within by their hidden motive (unhealthy activities, accompolished with intentions). you should videoing the scenario,(camera phone-evidence) ,any witnesses to avoid any accusation of fabrications , embarassing -situations to go with, ....Pray you would suceeds... :cool:
