My name is Audrey Seale and I am 15 years old. My mother lives here in Ashland Kentucky and my father lives in Farmington New Mexico. I am searching for information about emancipation of minors. Three years ago my dad was into drugs and alcohol so he desided that even though he had custody he didnt want to take care of me and my two younger siblings anymore so he sent us to live here in kentucky with my mother and her boyfriend. For two years he didnt call us or send my mom any kind of support. In two years he sent 2,000 dollers if you divide that by 24 months thats only about 83 dollors a month for a single mother working at a gas station trying to raise three kids and go to college thats not alot. When we would call him he would usually be at the bar and he wouldnt answer our calls. For two years he had nothing to do with us. Well in august 2004 he decided that he was going to (visit) us but that wasnt his intentions at all. He got there around 10:30 at night and didnt have enough money to get a motel so he so my moms boyfriend(Brett) said that it would be ok for my dad to stay at my moms house with me my brother and my sister and she would stay with Brett at his house. They werent liveing together at the time. My dad took the invatation and would stay there for the next two nights. On the second day he was there it was my schools first Varsity football game and I had been planning on going to support my school. After the game I went to the a church get together. When I got home my dad started getting on to me about school and what I was going to do about college. Me bieng only 14 at the time and just starting my freshman year had thought about colloge but had not looked into it that far. My dad told me that I wasnt going to get any were in my life without looking into it and that I wasnt ready cause I didnt have any paper work on any colleges. at first I was understanding cause I thought meaby that was him just bieng a conserned parrent but I would soo find out that the only reason that he was haveing the conversation with me was to get me to go stay with my mom that night so he would be able to leave and take my brother and sister that night back to New Mexico. The next day I had a Cheerleading fundraser at the foodland down the street well I was expose to be there at 10:00 in the morning well I woke up at 10:30 so I was already late . When I walked out of my room I found that my dad had been up for an hour and he said he didnt wake me up cause he didnt think it was his problem. I got ready and asked him for a ride and he told me that he wouldnt give me a ride cause I owed him an appology. I ended up walking to my cheerleading event. Later that day he called me and told me that he was on his way back to New Mexico and thathe had the kids with him. After that my mom called the cops and told them them the story. The cops looked into it but couldnt stop him from doing what he did cause he still had custody. For the next two months me and my mom looked into anything and everything we could to get the kids back. Every time my mom would get a court date set up he would get it posponed. Well As time went by me nd my mom went our seperate ways. She would always be at Bretts house and I would be with my friends. One day I asked to have some friends over and she said yes well she ended up that night not wanting it to happen so she told me no. After the football game people started showing up at my house cause they didnt know it wasnt happening so. I told them that we would have to leave and everyone areede but nobody left. Me and my friend Laura Had the idea that if we left that everyone else would fallow. We walked areound the block and waited for like ten min to go back and nobody had left. When we walked into the house everyone had walked into the back bedroom and sombody had brought drugs to the house. Whn I firt noticed what was going on I didnt know what to do so I told them that everyone seriosly needed to leave and that whoever had brought the drugs needed to leave asap cause I wasnt into drugs and they werent going to be in my moms house. Around that time my mom showed up at the house I was getting ready to leave for god cause I didnt want to be there if my mom did show up so it was kinda ironic cause me and her both touched the door handle at the same time . Well anyways I got introuble and I didnt like the trouble I was in so me bieng a stupid teenager told my mom that I was leaveing and that she couldnt stop me. I left and she called the cops. I Had a friend call my mom and tell her that I was okay and my mom told her that I needed to be home at 7:30 the next morning or the cops would be looking for me. The next morning came and I was planning on going home but It didnt happen I woke up late and my ride didnt get there intill 8:00 so by the time my ride got there so did the cops. I didnt want to get introuble so I tolled the cops that my mom abused me and I was afraid to go back. only part of that statement was true. My mom punished me and sometimes me and her got really phissical but it wasnt that bad. I ended getting put in a foster home and then sent back with my dad. Ronda Copley was my lawyer through the whole thing and when she asked me if I would just want to go back and live with my mom I told her i didnt know. What I really ment to say was yes but I felt really bad for all the trouble I had caused so the court sent me to New Mexico to live with my dad. I really dont want to live with my dad He Isnt all there he hd done drugs all through out my childhood almost and now that he dont do them anymore hes just not a very likeable persone. He and my stepmom(Lanita) fight all the time and he dont treat her very well. She has left my dad three times in the 8 months i have been liveing there. She says that the only reason that she comes back is for me and my younger siblings. I love her but shes not my mom I am 15 years old and even though me and my mom have been through alot I still love her and didnt want to hurt her and im looking for a way to make things right. Anyone can help me I would Deeply apreciate it. I am willing to do what ever it takes to live with my mom.

Kentucky has no per se emancipation statute. New Mexico does, Emancipation

New Mexico Statutes, Chapter 32A, Article 21.
On a practical note, even if KY has no emancipation statute, you can petition the juvenile court to remove the disabilities of being a minor or seek assistance from a school counselor or DCF for placement in foster care or with a trusted friend or relative who might be willing to be your legal guardian until you turn age 18.
