hi~ i understand that i have a job security once i file for maternity leave 12 wks under FMLA for employers who have 50 or more employees in 75 mile radius and pick up short term disability. my question is.... what if i've decided to be a stay at home mom and resign after i filed for maternity leave? whats gonna happened w/ that short term disability? can i still pick up short term disability if i know that i wont be coming back to work? Pls help!

We can't tell you because we don't know what type of disability benefit your employer is providing. If it's a fully insured disability plan through an insurance carrier, then the chances are considerable that if you are still employed at the time you become disabled from working due to your pregnancy, STD benefits will continue for the duration of the time you are medically disabled, even if you resign your employment in the meantime.
But you're going to have to ask your employer or read the fine print in the disability policy to know for certain.
