this happened in ky..my daughter was on the merry go round ..the pole of the horse she was on came out of the floor and threw her around and badly bruised her leg. we took her to the hospital and they done x-rays and said it wasnt broke just badly bruised..we have been in contact with the amusement rides insurance company but i am not sure what to say when the adjuster calls if they offer a settlement.what do you say to someone for my daughter being scared to death and hurt..she said she will never ride another ride again and she is 9..does anyone have any advice..thanks in advance.

I think you have a strong case against the amusement park and potentially the manufacturer of the ride. They have a high duty of care to their patrons. Their duty is to assure the safety of all invitees. Based on your post, they clearly failed to meet that duty and that negligence is the direct cause of the injury.
What the injury is worth is part where I think you will see varying opinions. She would be entitled to 2 main categories of damages. Special Damages: (Bills incurred and any proven wages lost as a direct result of the injury) and General Damages: (pain and suffering, the emotional trauma that she is enduring) It's difficult to put a value on the Generals. It greatly varies, depending on the venue that you are in. I am not very familiar with the Quantum studies of your state.

..LIKELY you and your spouse could file additional claims for all undertakings - difficulties,in caring of your injured daughter,time waste, loss, your emotional - physicological distress / disturbances..sleepless (sleeping pills-if any), nightmare (sudden wake in night-if any)transportations to medical provider,its happened solely due to negligence-duty of care , by the owner (amusement park ?) you should retained all documents pertaining causes or occurances of accident-police,medical records,witnesses (in any) or photograps (if any,in my case I normally snapped on my own) www.weitzlux.com , hopes she would be well soon
